New 90-day claims rule expected from 1 December 2026: what providers need to know

We want to give providers early notice of an important upcoming change to NDIS claiming timeframes, and to encourage you to submit any outstanding invoices to Kismet now.

What's changing

The Australian Government's NDIS Amendment (Securing the NDIS for Future Generations) Bill 2026 is currently before Parliament. It has passed the House of Representatives and is now with the Senate, where it's expected to pass this month.

Among other reforms, the Bill reduces the timeframe for submitting claims for NDIS supports from 2 years to 90 days from the date the support was delivered.

  • The new 90-day rule is set to commence on 1 December 2026.
  • It applies to all claims submitted on or after that date, regardless of when the support was delivered.
  • From 1 December 2026, a claim for a support delivered more than 90 days earlier generally cannot be paid. Only limited exceptions will apply, at the NDIA's discretion, where exceptional circumstances prevented a timely claim.

What this means for you

If you have any unbilled services, even from many months ago, the safest course is to invoice them now.

  • In practical terms, any support delivered before early September 2026 will fall outside the 90-day window once the new rule starts.
  • The Government has deliberately delayed commencement to 1 December 2026 to give providers time to submit older claims under the current 2-year rule. This is a closing window.

What you should do now

  • Review your records for any services delivered to participants we plan manage that you haven't yet invoiced.
  • Submit any outstanding invoices to Kismet as soon as possible. Don't wait for the legislation to pass or for the December deadline.
  • Going forward, we recommend moving to invoicing promptly after service delivery (ideally weekly or fortnightly), so the 90-day rule never becomes an issue for your business.

Submitting now also means faster payment for you, and gives us time to resolve any queries on older invoices while they can still be claimed.

A note on timing

The legislation has not yet passed Parliament, and the details above may change during the Senate process. However, the 90-day measure has to date been unamended, and we consider it prudent for providers to act on the basis that it will commence on 1 December 2026 as planned. We'll confirm the final position once the Bill passes.
